When the matter is taken up for hearing, learned Government Counsel appearing for respondents 1 & 2 submitted that during the pendency of the Writ Petition, the tender period had expired and hence nothing survives for further adjudication. 3. In view of the aforesaid submission, this Writ Petition stands dismissed as infructuous with liberty to the petitioner to submit a representation seeking refund of any amount that may be due and payable. There shall be no order as to costs.
