Appellant Sudarshan Kumar has filed the present application, under Order 39 rules 2A of the CPC with the following prayer:- “ It is therefore, respectfully prayed that this application may kindly be allowed and respondent No.1 may very kindly be prosecuted and punished for knowing and willful disobedience of the orders passed by this court to upkeep the majesty of law in high esteem, in the interest of justice.” Since respondent No.1, has expired, as such, the present application has become infructuous, as the legal representatives cannot be penalized under Order 39 Rule 2-A of the CPC.
