For the Respondent: Ms. Pooja Thakur, Advocate. _______________________________________________________ Sandeep Sharma, Judge(oral): While placing on record copy of Death Certificate dated 08.01.2026 issued by the Registrar (Birth & Death) Dr. Radhakrishnan Government Medical College & Hospital, Mr. J.R. Poswal, learned counsel for the petitioner, states that petitioner has expired, as such, present proceedings have abated. He fairly states that sums of Rs.25,000/- and Rs. 10,000/-, respectively, lying deposited with the learned trial Court can be ordered to be released in favour of the respondent. 2. While fairly acknowledging factum with regard to the death of the petitioner, Ms. Pooja Thakur, learned counsel representing the respondent, states that though present petition may be disposed of as having abated, but liberty may be reserved to the 1Whether the reporters of the local papers may be allowed to see the judgment? 2 respondent to seek release of the entire compensation amount awarded by the learned Court below in accordance with law. 3. Since the petitioner has expired, on 05.01.2026, which is evident from the Death Certificate, the present proceedings cannot be continued, as such, the same are disposed of as having abated. Amount(s), as detailed hereinabove, are ordered to be released in favour of the respondent by the learned Court below by remitting the same in the bank account of the respondent, details whereof shall be furnished within two weeks from today. Needless to say, respondent can always file appropriate proceedings in the appropriate Court of law qua realization of the remaining compensation amount, if required and desired.
