VERSUS
SHRI SHALEEN KABRA AND ORS.
…Respondent(s)
Through: Mr. Jahangeer Ahmad Dar, Government Advocate.
CORAM:
HON’BLE MR. JUSTICE WASIM SADIQ NARGAL, JUDGE.
ORDER 08.04.2026
01. The instant contempt petition arises out of an order passed by this Court dated 01.11.2023 in WP(C) No. 2789/2023, by virtue of which the writ petition preferred by the petitioner was disposed of with a direction to consider the payment due and payable to the petitioners in accordance with the terms and conditions of the contract work orders and an appropriate decision was to be taken within a period of three months from the date of passing of the aforesaid order.
02. Since the aforesaid order was not complied with, the petitioners preferred the instant contempt petition in which notice was issued on
15.05.2024. The compliance report stands filed on behalf of the respondents on 05.05.2025, and along with the compliance report, the respondents have also placed on record the detailed consideration
order dated 16.03.2024. A perusal whereof reveals that the case of the petitioners stands rejected, being devoid of any merit, after the claim of the petitioners was considered in terms of the order passed by this Court mentioned supra. 21 Regular
03. Heard learned counsel for the parties and also perused the compliance report and the stand taken by the respondents in the detailed consideration order. Since the instant contempt petition has been preferred against the order passed by the learned writ court, whereby a direction was issued to the respondents to consider the claim of the petitioner in accordance with the terms and conditions of the contract work orders and a detailed consideration order has been passed, this Court is of the view that the order passed by the learned writ court stands complied with. Thus, no contempt is made out and accordingly, proceedings in the instant contempt petition are closed.
04. Rule, if any, shall stand discharged. However, dismissal of the contempt petition shall not come in the way of the petitioners to agitate his cause by way of appropriate proceedings challenging the aforesaid consideration order.
05. CCP(S) No. 175/2024 stands disposed of.
