The case of the petitioner is that she is working as a Nurse at Primary Health Centre, Arakkonam on contract basis. Her husband is working in Dubai as an Automobile Technician and he usually transfers his salary amount to the petitioner’s Bank account through Foreign Exchanges. While so on 22.08.2024, an amount of Rs.1,00,000/- was given as loan by the petitioner’s husband to his friend upon the promise that the amount borrowed would be paid back within a week. Thereafter, his friend returned the amount in the petitioner’s Bank Account after a week and in turn the petitioner transferred the said amount to his own Canara Bank Account. 3. While the matter stood thus, on 01.09.2024, the petitioner was informed through a mail from the 2nd respondent Bank that the account has been blocked due to a complaint received from the 3rd respondent and the disputed amount has been frozen. When the petitioner communicated to the bank about the freeze, no proper response was given by the officials. The learned counsel appearing for the petitioner would submit that the disputed amount is originally received from an account unknown to the petitioner as a return of debt lend by a friend of her husband. Without considering the petitioner’s case, the 2nd respondent has blocked the account. Therefore, this Court may issue appropriate direction to defreeze the bank account of the petitioner. 4. The learned counsel appearing for the respondents would submit that based on the complaint given by the 3rd respondent, only the disputed amount of Rs.40,514/- has been frozen in the petitioner’s bank account. The petitioner may be permitted to operate the account insofar as the balance amount is concerned. 5. Heard the learned counsel appearing for the petitioner and learned counsel appearing for the respondents. 6. In view of the fair submission made by the learned counsel for the 2nd respondent, this Court, without going into the merits of the case, directs the respondents 1 and 2 to withhold only the disputed amount of Rs.40,514/- in the petitioner’s bank account and permit the petitioner to operate the account in respect of the remaining balance amount. https://www.mhc.tn.gov.in/judis WP No. 36378 of 2024 __________ Page4 of 5 7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
