This joint application is filed on behalf of Plaintiff and Defendant No.3 for recording of settlement between the parties. 2. This suit has been filed on behalf of Plaintiff inter alia seeking permanent injunction restraining the Defendants and all others acting on their behalf from using Plaintiff’s Kapiva family marks. 3. During the pendency of the suit, Plaintiff and Defendant No. 3 have amicably settled their inter se disputes and terms of settlement are incorporated in paragraph 5 of the application. 4. Court has perused the terms of settlement and finds the same to be lawful. Accordingly, this application is allowed and disposed of recording the settlement between the parties. This application is filed on behalf of the Plaintiff for withdrawal of the suit under Order XXIII Rule 1 CPC qua Defendants No. 1 and 4. 8. For the reasons stated in the application, the same is allowed permitting the Plaintiff to withdraw the suit qua Defendants No. 1 and 4. 9. Application stands disposed of. CS(COMM) 302/2024 and I.A. 8103/2024 10. In light of the aforesaid developments, the suit is decreed in favour of Plaintiff and against Defendants No. 2 and 3 and disposed of as withdrawn qua Defendants No. 1 and 4. 11. Needless to state that terms of settlements between the Plaintiff and Defendants No.2 and 3 shall form part of the decree and bind the parties thereto. 12. Registry is directed to draw up the decree sheet. 13. Suit along with pending application stands disposed of. 14. Date of 23.11.2026 before learned Joint Registrar stands cancelled.
