For Petitioner(s): Mr.Logeshwaran for Ms.A.Aishwarya For Respondent(s): Mr.S.Madhusudanan Standing Counsel for R1 to R3 No appearance for R4 O R D E R This Writ Petition has been filed challenging the impugned order passed by the second respondent vide proceedings in Ka.No.U.PO/E & Pa/West/Sa.Saary/Va.AA/Ko.thani/No.93/20-21 dated 23.11.2021 and Ka.No.U.PO/E&PA/West/SA.Sari Vru.AA/Ko.thani/No.071/22-23 dated 22.08.2022 and for a consequential direction to the respondents 1 to 3 to grant a temporary new service connection to the petitioner, pending disposal of R.C.O.P.No.68 of 2011 filed by the petitioner for restoring electricity connection before the District Munsif Court, Vellore. 2. The petitioner is running the business in the premises belonging to the fourth respondent. Since the petitioner had requested for a separate service connection, for which, the fourth respondent did not agree and she disconnected the service connection affecting the petitioner’s business operation, which gave https://www.mhc.tn.gov.in/judis WP No. 3178 of 2024 __________ Page3 of 5 rise to file R.C.O.P.No.68 of 2011 before the District Munsif Court, Vellore, to restore the electricity service connection and R.C.O.P.No.2 of 2015 has also been filed by the fourth respondent to evict the petitioner from the premises. Both the cases are still pending. The petitioner has sent representations to the District Collector and Municipality on various dates. There has been also writ petition filed before this Court earlier with respect to the dispute pending between the parties. 3. Now, the learned counsel appearing for the petitioner submits that since the civil proceedings are pending between the petitioner and the fourth respondent before the District Munsif Court, Vellore, the petitioner may be granted liberty to file an appropriate application before the said Court seeking electricity service connection. 4. Recording the said submission made by the petitioner and after hearing the learned Standing Counsel appearing for the respondents, this Court, without interfering with the impugned orders, is inclined to dispose of this writ petition with liberty to the petitioner to file an appropriate application before the civil Court in the pending proceedings seeking electricity service connection. https://www.mhc.tn.gov.in/judis WP No. 3178 of 2024 __________ Page4 of 5 5. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
