The present Transfer Petition, under Section 24 of the Code of Civil Procedure, 1908, seeks the transfer of the Petition for grant of Succession bearing No. 164/2023, titled “Priti Verma v. State & Others”, pending before the learned ACJ/ARC (North-West), Rohini Courts, Delhi [“learned ACJ”], to the Court of the learned ACJ/ARC (West), Tis Hazari Courts, Delhi [“learned Transferee Court”], where Succession Petition bearing No. 167/2023, titled “Vandana Verma v. State & Others”, filed by Respondent No. 3, is stated to be pending. 2. A perusal of the paper-book reveals that Respondent No. 2, i.e. Smt. Respondent No. 1 is the State (Government of NCT of Delhi), while Respondent Nos. 3, 4 and 5 are, respectively, the MTNL Corporate Office, the Branch Manager, State Bank of India, Sector-9, Rohini, New Delhi, and the Branch Manager, Union Bank of India, Sector-8, Rohini, New Delhi, who are not the contesting parties. 3. The Order dated 12.02.2026 records that Respondent No. 2 stood served; however, none appeared on her behalf, and the matter was, accordingly, re-notified for 24.07.2026, while adverse orders were deferred in the interest of justice. 4. Thereafter, none appeared on behalf of Respondent No. 2 on 24.07.2026. Even today, i.e. 07.09.2026, there is no appearance on behalf of Respondent No. 2. 5. In view of the repeated absence of Respondent No. 2, despite service and sufficient opportunity, this Court proceeds to hear the present Petition in her absence. 6. Further, it is also noted that, despite being served, none has appeared on behalf of Respondent Nos. 1, 4 & 5. 7. Learned counsel appearing on behalf of Respondent No. 3 submits that Respondent No. 3 has no objection to the present Petition being allowed. 8. This Court has considered the averments made in the present Petition as well as the no-objection expressed by learned counsel appearing on behalf of Respondent No. 3. Respondent No. 2, being the only contesting Respondent, has chosen not to appear despite repeated opportunities. 9. Accordingly, the present Petition is allowed and the Succession Petition bearing No. 164/2023, pending before the Court of the learned ACJ, is transferred to the Court of the learned Transferee This is a digitally signed order.
