1. The present Revision Petition has been filed under Section 25- B(8) of the Delhi Rent Control Act, 1958, seeking to set aside the Impugned Order/Judgment dated 29.02.2024 passed by the learned Additional Rent Controller (ARC-02), District Central, Tis Hazari Courts, Delhi in Eviction Petition No. 125/2020 (RC ARC 370/2020), titled as “Ashok Kumar Bahl vs. Sanjan Kapoor”. 2. None appears on behalf of the Petitioner. 3. It is noticed that even on the last date of hearing, none had appeared on behalf of the Petitioner, which had constrained this Court to pass directions vacating the Impugned Order and permitting the Respondent to proceed with the execution proceedings. 4. Respondent herein. 5. He, therefore, submits that nothing survives in the present matter and that the same may accordingly be disposed of, in light of the fact that possession has already been taken over by the Respondent. 6. This Court has heard the Respondent, who appears in person. 7. It is noted that by the Order dated 19.05.2026, this Court had recorded therein the submission of the Petitioner that the premises will be vacated on or before 31.10.2026. 8. Due to the fact that no Affidavit of Undertaking was placed on record, the earlier Interim Order dated 21.11.2024 had been vacated and the execution proceedings were permitted to proceed. 9. Considering that possession has now been taken over by the Respondent, and also keeping in view the fact that despite repeated opportunities, none has appeared on behalf of the Petitioner, this Court is of the view that no purpose would be served in keeping the present matter pending. 10.
