1. Petitioner i.e. customs is aggrieved by order dated 29.01.2024 whereby respondent-accused had been permitted to travel abroad to his native country for a period of 30 days on fulfillment of certain conditions. Petitioner/Customs has also challenged consequent order dated 12.07.2024 whereby the Lookout Circular (LOC) issued against the respondent accused has been recalled/suspended in order to enable him to undertake the abovesaid travel.
2. When the present petition was taken up by this Court on 12.08.2024, the impugned orders dated 29.01.2024 and 12.07.2024 were stayed.
3. The next date in the present matter is 18.12.2026.

Learned counsel for the respondent has, in the interregnum, moved the abovesaid application praying therein that the present petition be disposed of as having become infructuous. terms of the permission granted by the learned Trial Court, left India on 06.08.2024 and has already returned back.
5. During course of the arguments, learned counsel for the respondent submitted that the respondent is present in Court today and duly identifies him. He submits that since the limited relief involved in the present petition was with respect to the permission granted by the learned Trial Court to the respondent-accused to travel for a period of 30 days and since the abovesaid journey has already been undertaken, nothing survives for any further adjudication in the matter. He submits that in future, if the accused is desirous of undertaking any further travel, he would move appropriate application before the learned Trial Court seeking permission.
6. Quite clearly, nothing remains in the present petition in view of the fact that the applicant has already travelled abroad and had left India on
06.08.2024. The stay was granted by this Court much later i.e. on
12.08.2024.
7. In view of the above, while allowing the abovesaid application, the present petition is disposed of, as having become infructuous. It is, however, clarified that the LOC against the applicant stands revived automatically and, in future if the respondent wants to go abroad, he would be required to take appropriate permission from the learned Trial Court.
8. The petition stands disposed of in aforesaid terms.
9. The next date i.e. 18.12.2026 stands cancelled.
10. A copy of this order be sent to learned Trial Court for information.
