This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- “1. That this Hon'ble Court may kindly direct all the respective Respondent(S) to produce the entire record pertaining to the petitioner’s case, including but not limited to all relevant documents related to the Registration, Certificate of Registration, Board Members Authorization Letter, Financial transactions, and Audit Reports, Income Tax Returns (Exemptions if claimed), Government Benefits and This is a digitally signed order. That this Hon'ble Court may direct Respondents R/1, R/2, R/3 to investigate R/4, R/5, R/6, R/7, R/8 , R/9 with specific reference to the violations of the Master Circular dated 01.07.2014 and 01.07. 2016 of the RBI on fraud classification and reporting, incidence of frauds, Know Your Customer (KYC) norms, and the failure to link the PAN and Aadhaar cards of the association, and to issue the necessary directions for rectification. 3. That this Hon'ble Court may direct R/1, R/2, R/3 to take immediate action against R/4, R/5, R/6, R/7, R/8 , R/9 for failing to comply with KYC norms, the RBI guidelines on fraud classification and reporting, and the failure to disclose necessary reports as mandated under the applicable laws, including the Societies Registration Act, 1860 and Banking Regulation Act 1949. 4. That this Hon'ble Court may kindly order that the R/5, R/6, R/7 , R/9 be held accountable for their actions in unlawfully misrepresenting the leadership of the association and for committing financial fraud, including siphoning of funds and money laundering, and to direct the concerned Enforcement authorities to initiate appropriate criminal proceedings. 5. That this Hon'ble Court may issue directions to Respondent No. 7 and Respondent No. 6 for the recovery and proper auditing of all funds, Income Tax Return and validity of PAN This is a digitally signed order. That this Hon'ble Court may issue any other relief deemed appropriate in the interest of justice, including but not limited to the cancellation of the unlawful bank account opened in the name of AISCTREA R/8 operated by R/6 , R/9 in association with R/4 and the imposition of penalties for the violation of banking regulations society registration laws , RBI GUIDELINES; Master Circulars along with investigation by needed enforcement agencies to dismantle the series of fraudulent and unauthorized transaction in the bank account of AISCTREA and Respondent R/4, R/5, R/6, R/7, R/9 in association till date. ...” 2. Ms. Kapoor, states that the petitioner has made a complaint to the respondent No. 3, therefore, the petition is not maintainable. 3. The petition is disposed of directing the respondent No. 3 to consider and decide the representation of the petitioner dated 21.10.2024 expeditiously and in accordance with extant rules and regulations. 4.
