CRL.M.C. 4593/2024 1 $~28 * IN THE HIGH COURT OF DELHI AT NEW DELHI Date of Decision: 25thAugust, 2026 # CNR No. DLHC010339052024 + CRL.M.C. 4593/2024 VIMAL KUMAR .....Petitioner Through: Ms. Sandhya Gupta, Advocate with petitioner in person. versus THE STATE NCT OF DELHI AND ANR. .....Respondents Through: Ms. Richa Dhawan, APP for the State with SI Abhay Bhati, PS Laxmi Nagar. Mr. S.K. Saha, Mr. Virender Khari and Mr. N.P. Singh, Advocates for respondent No.2 with respondent No.2 in person. CORAM: HON'BLE MR. JUSTICE MANOJ JAIN J U D G M E N T (oral) 1. Petitioner herein seeks quashing of FIR No. 119/2020 dated 03.03.2020, registered at Police Station Laxmi Nagar, Delhi, for commission of offence under Section 509 IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. 2. FIR was registered on the basis of the complaint made by respondent No.2 herein, who reported to the police that on 02.03.2020, when she was present at her house, somebody rang the door bell and banged at the door loudly. She, eventually, found that it was done by Vimal Kumar (petitioner herein), who was son of her landlord. When she came down, he started abusing her and it was in the abovesaid backdrop that the FIR has been Signed By:SONIA THAPLIYAL Signing Date:29.08.2026 13:11:08 Signature Not Verified CRL.M.C. 4593/2024 2 registered. 3. Charge-sheet has already been filed albeit charges are yet to be framed. 4. During proceedings of the abovesaid matter, the parties were referred to mediation and they were able to settle all their disputes under the aegis of Mediation Centre, Karkardooma Courts, Delhi on 12.02.2024. Copy of such settlement is placed on record. As per the settlement terms, one suit for possession and recovery of arrears of rent has also been settled between the parties. 5. It is in the abovesaid backdrop that quashing is being sought. 6. Respondent no. 2 is present in person and she has been duly identified by her counsel as also by Investigating Officer. 7. When asked, respondent No. 2 reiterates the terms of settlement and submits that the matter has been amicably settled and she has entered into the abovesaid settlement out of her own free will, without any coercion and influence from any corner whatsoever and therefore, she would have ‘no objection’ if FIR in question is quashed. 8. In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is, primarily, private in nature. In any case, even the complainant does not wish to press any charges against the petitioner. 9. Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIR. 10. Consequently, to secure the ends of justice, FIR No. 119/2020 dated 03.03.2020, registered at Police Station Laxmi Nagar, Delhi, for commission Signed By:SONIA THAPLIYAL Signing Date:29.08.2026 13:11:08 CRL.M.C. 4593/2024 3 of offence under Section 509 IPC, along with all consequential proceedings arising therefrom, is, hereby, quashed. 11. Original affidavits of the parties, copies of which have been placed on record in the present proceedings, shall be submitted before the learned Trial Court within four weeks from today, so that these become part of Trial Court Record. 12. The petition stands disposed of in aforesaid terms. (MANOJ JAIN) JUDGE AUGUST 25, 2026/st/js Signed By:SONIA THAPLIYAL Signing Date:29.08.2026 13:11:08
