1. Application under Ordre XXIII Rule 3 read with Sections 107(2) and 151 of CPC has been filed on behalf of the Appellant in view of settlement between the parties.
2. It is submitted that matter has been amicably settled between the Appellant (Defendant No.1) and Respondent No.1 (Plaintiff), though it is being continued against Respondent No.2 (Defendant No.2).
3. Parties under that liability is joint and separately, despite which on account of NOC given by the Plaintiff, Appellant seeks permission to withdraw present Appeal.
4. In view of the terms and conditions of the Settlement, incorporation in this Application, to which parties undertook to remain bound, Appeal is permitted to be withdrawn.
