CORAM: HON'BLE MR. JUSTICE SACHIN DATTA % 18.08.2026 O R D E R 1. The present petition seeks enforcement of an arbitral award dated 19.08.2023. Admittedly, the entire award amount (inclusive of interest) stands deposited in these proceedings. 2. Learned senior counsel for the decree holder seeks leave to withdraw the said amount. It is stated that upon withdrawal of the said amount, the decree shall stand satisfied. 3. It further transpires during the course of hearing,that the petition under Section 34 of the Arbitration and Conciliation Act, 1996, filed by the respondent already stands dismissed. 4. Learned counsel for the judgment debtor seeks some time to verify whether any SLP has been filed against the dismissal of the petition under Section 34 of the Arbitration and Conciliation Act, 1996 and / or the consequential appeal under Section 37 of the Arbitration and Conciliation Act, 1996. 2. List on 18.08.2026 in the category of ‘supplementary matters’.” 5. Today, the learned counsel for the judgment debtor submits that he does not have any instructionsas regards whether any petition under Section 37 of the Arbitration and Conciliation Act, 1996 and/or any SLP was filed against the judgment/order dated 07.07.2026, whereby, the petition under Section 34 of the Arbitration and Conciliation Act, 1996 was dismissed. 6. In the circumstances, the deposited amount is directed to be released to the decree holder. 7. It is acceded that the same would fully satisfy the claim of the decree holder. 8. The Registry is directed to release the requisite amount along with the accrued interest to the decree holder as expeditiously as possible. 9. The petition is disposed of in the above terms.
