Order dated 23.01.2025 reads as under: “1. The present petition has been filed under Article 226 and 227 of Constitution of India read with under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (‘BNSS’) read with Section 482 of the Code of Criminal Procedure, 1973 seeking quashing of FIR No. 41/2017 dated 12.02.2017 registered under Sections 307/452/34 of the Indian Penal Code, 1860 (‘IPC’) and Sections 25/27/54/59 of the Arms Act, 1959 (‘Arms Act’) at P.S. Rani Bagh. 2. Petitioner Nos. 1, 2, 3 and 4 are present in Court and have been identified by the learned counsel for the Petitioner and the Investigating Officer (‘IO’). Respondent No. 2 as well is present in Court and has been identified by the IO. 3. Learned counsel for the Petitioner states that though the present FIR has also been filed under the Arms Act, it is a matter of record that no weapon was recovered. 3.1. He states that the alleged injury suffered by Respondent No. 2 is also not related to any fire arm. This is a digitally signed order. He states parties have mutually settled their disputes and in this regards he relies upon the Memorandum of Understanding dated 07.12.2024 (MoU). 3.3. He states that there is no other case pending against the Petitioners and since parties have agreed to resolve the disputes, the prayer for quashing the present FIR may be accepted. 4. Respondent No. 2, who is present in Court confirms the execution of the MoU as well as the affidavit-cum-NOC dated 13.12.2024 filed by Respondent No. 2 in support of this petition. 5. The submissions of the Petitioners and Respondent No. 2 are taken on record and they are bound down to the same. In view of the facts recorded hereinabove, Petitioner Nos. 1 to 4 as well as Respondent No. 2 are exempted from further appearance. 6. Learned ASC appearing for the State submits that as per the chargesheet, there is a fifth accused, namely, Ms. Simmi; however, she has not been arrayed as a Petitioner herein. 7. Learned counsel for the Petitioners states on instructions from Petitioner Nos. 1 to 4 that they reasonably believe that Ms. Simmi has since passed away, and this fact may be verified by the State. He states that Ms. Simmi was a resident of State of Punjab. 8. Learned ASC seeks two (2) weeks’ time to verify the said submission of the Petitioners qua Ms. Simmi. 9. At request of the parties, list on 05.03.2025 at 02:30 P.M.” 2. It would however be noted that one of the accused since was not arrested, therefore, the formal order of quashment of the FIR was not passed. It is pointed out that the said accused namely Simmi has expired. This fact has been verified by the police. Therefore, there is no impediment in passing of the formal order of quashment of the FIR and all actions taken pursuant thereto. 3.
