This suit was instituted by the Plaintiff inter alia seeking a decree of permanent injunction restraining the Defendant and all others acting on its behalf from manufacturing, marketing, advertising and selling its agricultural products such as Rotavators and/or any other allied or cognate goods bearing the marks “SHAKTIMAN/SHAKTINAM WBH” and trade dress having device of a person showing muscular power and/or any other mark identical or deceptively This is a digitally signed order. During the pendency of the proceedings, parties have amicably settled their inter se disputes whereby Defendant has agreed not to use the impugned marks/trade dress and/or any other mark identical or deceptively similar to Plaintiff’s registered SHAKTIMAN trademark and has also agreed to pay a sum of Rs. 1 lakh to the Plaintiff in full and final settlement of its claims towards damages and costs, which the Defendant shall pay within three weeks from today. 3. The suit is decreed in terms of the settlement between the parties and needless to state the parties shall be bound by the terms. Defendant shall file an affidavit of undertaking within a period of two weeks from today, with advance copy to counsel for the Plaintiff. 4. Registry is directed to draw up the decree sheet. 5. Suit stands disposed of along with pending applications. 6. Plaintiff is held entitled to refund of entire Court fees in accordance with the Court Fees Act, 1870. 7.
