Status report filed by the respondent reads as under: “Briefly stated that FIR No 436/24 Dated 24.06.2024 u/s 25/54/59 Arms Act PS IGI Airport, New Delhi was registered on the complaint of SI Puneet Kumar Tiwari CISF No: 110404752 S-2 Coy, CISF Unit IGI Airport, New Delhi wherein it was informed that on 24.06.2024, at about 0253 hrs, a passenger namely ; Mr. Yogesh Sharma, Aadhar Card No-481414092168, taking flight No.-Al 443, Seat No-6F, travelling from Delhi to IXU (Aurangabad) reported at X-BIS-06 in Domes.tic SHA, Terminal-03 IGI Airport New Delhi and placed his hand bag for screening. During screening, he noticed the image of ammunition and referred his bag for physical check. The same hand baggage was identified by the said pax and physically checked by him in his presence. While carrying out the physical check, he recovered 06 live ammunition mark .32 S&W. L K.F. from his hand baggage. The said passenger was not having any valid license in his possession for carrying live ammunition in his hand baggage. As per BCAS Circular No. 08/2017, the passenger Mr. Yogesh Sharma along with recovered 06 live ammunition mark .32 S&W. L K.F. handed over to This is a digitally signed order. An offence u/ s 25 / 54 / 59 Arms Act was found made out. Thus, present FIR was registered and investigation taken up. During investigation a Notice under 35 BNSS (41-A CrPC) was served upon Yogesh Sharma to join investigation wherein he disclosed that on 24.06. 2024 he was travelling from Delhi lo Aurangabad carrying bag of his father Mr. Shyam Sunder Sharma. He used the bag for his travel luggage without checking it and left for IGIA New Delhi where during checking 06 live ammunition marked .32 S & WLKF 7.65KF were recovered from the bag belonging to his father Mr. Shyam Sunder Sharma holder of Arms License No. -1252 Sasani Gate, Aligarh, U.P. In these facts and circumstances accused Yogesh Sharma was bound down as per procedure. The recovered 06 live ammunition were deposited in FSL, Rohini, Delhi for examination on 20.09. 2024 vide SFSL(DLH) 122285/BAL/1123/24 Dated 20.09.2024. A report from FSL is awaited. During investigations a letter was sent to DM, Aligarh, U.P. for verification of Arm License No. 1252, Sasani Gate, Aligarh, U.P. issued in favour of Mr. Shyam Sunder Sharma. As per report dated 23.11.2024 received from DM, Aligarh, U.P this Arm License is duly issued to Mr. Shyam Sunder Sharma s/o Brijwassi Lal Sharma r/o 147 Awass Vikas Colony, PS Sasani Gate, Aligarh, U.P to possess an NPB Revolver No P-0896 of .32 bore valid in U.P and 25 live ammunition in a calendar year with a validity period up to 19.02.2027. It also surfaced that he had arranged 10 live ammunitions against his Arm License from M/S Pathak Gun House, Aligarh, U.P. These facts are duly verified by Mr. Parmod Kumar Pathak, owner of M/S Pathak Gun House, Aligarh , U.P. During investigation statement of Mr. Shyam Sunder Sharma has also been recorded wherein he has also verified these facts. Investigation of the case is in progress. The undersigned shall abide by the directions passed by Hon’ble High Court.” 2. In view of the aforesaid, the FIR and all actions taken pursuant thereto stand set aside. 3.
