The present writ petition has been filed seeking setting aside of the order passed by the respondent no.1/MCD on 28th December, 2023, directing seizure of the vehicle of the petitioner bearing No. DL4CAQ 5175 as being ‘End of Life’ vehicle. The vehicle was further directed to be handed over for scrapping as per the Motor Vehicles (Registration and Functions of Vehicle Scrapping Facility) Rules, 2021 (‘RVSF Rules’). The petitioner also seeks a direction to the respondent no.2/Authorized Scrapper to return the seized vehicle. 2. Subsequently, an affidavit has been filed on behalf of the respondent no.2/Authorized Scrapper on 11th March, 2024 stating that the petitioner’s vehicle was handed over to the respondent no.2/Authorized Scrapper by officials of MCD on 28th December, 2023. Since nobody came forward, the petitioner’s vehicle was scrapped on 7th February, 2024. 3. Pursuant to the order passed by this Court on 12th August, 2025, the respondent no.2/Authorized Scrapper has placed on record calculation with regard to the value of the scrapped vehicle of the petitioner. 4. As per the said calculation sheet filed by the respondent no.2/Authorized Scrapper, the petitioner is entitled to payment of Rs.20,077/- towards scrap value, subject to the petitioner complying with the prescribed formalities. 5. In view thereof, the present writ petition is disposed of while granting liberty to the petitioner to approach the respondent no.2/Authorized Scrapper to claim the aforesaid scrap value. 6. Needless to state, all rights, contentions and legal remedies of the petitioner are kept open. 7. Pending application stands disposed of.
