The present Petition has been filed under Article 227 of the Constitution of India, 1950, challenging the Order/Directions dated 01.07.2024 [“Impugned Order”] passed by the learned Judge, Family Court, Patiala House Courts, Delhi, in case being HMA 580/2018, titled “Alok Srivastava v. Kriti Srivastava”. The reliefs, as sought for in the present Petition, read as under:
“…. a) Pass an Order setting aside Order 01.07.2024 passed in HMA No. 580 of 2018 pending before the Judge, Family Court, Patiala House Courts, New Delhi titled as ‘Alok Srivastwa vs Kriti Srivastwa’ next listed for 08.08.2024 and permit the Petitioner Wife to Cross Examine, PW-1 and the other witnesses. b) pass an order or direction directing the learned Family Court to expeditiously decide the Application dated 18.01.2024 under Section 26 of H.M.A. filed by the Petitioner Wife in HMA No. 580 of 2018 pending before the Judge, Family Court, Patiala House Courts, New Delhi titled as ‘Alok Srivastwa vs Kriti Srivastwa’ forthwith. …” This is a digitally signed order. Learned counsel appearing on behalf of the Petitioner, after arguing for some time, on instructions, submits and undertakes that given a last indulgence and opportunity by this Court while allowing the present Petition, the Petitioner shall not seek any further adjournments in the matter and that cross-examination will proceed on a day-to-day basis before the learned Family Court.
3. Per contra, Respondent, who appears through video conferencing, submits that his only concern is with respect to the delay which may be occasioned, but he would be satisfied if this Court passes appropriate directions to the effect that the matter will be taken up on a day-to-day basis.
4. This Court has heard learned counsel appearing on behalf of the Petitioner at length, as well as the concern raised by the Respondent and also perused the Order impugned herein.

This Court is of the considered view that it need not get into the merits of the issue as it believes that it would cause considerable embarrassment to the learned counsel appearing on behalf of the Petitioner. However, at this stage and considering the peculiar facts and circumstances of the present case, this Court, in the interest of justice and in view of the undertaking given by the learned counsel for Petitioner, deems it appropriate that the Petitioner be permitted to cross-examine PW-1 and other witnesses, subject to payment of costs of Rs. 25,000/- to be made to the Respondent herein. It is made clear that the Petitioner would be bound by the undertaking that the Petitioner will not seek any further adjournments in the matter and that cross-examination will proceed on a day-to-day basis before the learned Family Court.

the terms and undertakes to ensure that the cost will be paid to the Respondent within a period of two weeks from today.
7. In view of the foregoing and subject to the payment of the cost by the Petitioner herein to the Respondent, the Order impugned herein is set-aside.
8. List before the learned Family Court on the date already fixed, i.e., 10.09.2026, for the purpose of fixing dates for cross-examination on behalf of the Petitioner.
9. Since this Court has already passed the directions to that effect, the Respondent submits that he is satisfied.
10. The present Petition, along with pending application(s), if any, stands disposed of in the above terms.
