The respondents 2 to 9, who are the co-defendants are not necessary parties. Being satisfied with the reasons assigned in the affidavit filed in support of the petition, the delay of 908 days in filing the second appeal is condoned on condition that the petitioner/appellant makes a payment of Rs.1,000/- (Rupees one Thousand only) to the credit of 'Chief Justice Relief Fund, Madras High Court', within a period of two weeks from the date of receipt of copy of the order, failing which, the condone delay petition in C.M.P.No.29791 of 2024 shall stand automatically dismissed. 5.
