1. The present petition has been filed alleging non-compliance of the orders dated 22nd November, 2022 and 03rd March, 2023 passed by this Court in CS(COMM) 728/2022, wherein, the suit was decreed in favour of the petitioner.
2. By way of the said orders, the respondent was restrained from using the trademark ‘EVERSHINE BOOKS’, and was further directed to delist all the inventories from online market place and take down the website ‘www.evershinebooks.in’.

Learned counsel appearing for the respondent draws the attention of this Court to the Compliance Affidavit dated 30th June, 2025, wherein, it has been stated as follows:

4. A further Affidavit of compliance has also been filed on behalf of the respondent dated 10th April, 2026, relevant portions of which, reads as under:

Thus, learned counsel appearing for the respondent submits that they have duly complied with the aforesaid orders passed by this Court and have not used the trademark ‘EVERSHINE BOOKS’ thereafter. 6. This Court notes that vide the earlier orders, the petitioner had stated that the product under the mark ‘EVERSHINE’ was still available on online platforms, i.e., Amazon and Flipkart. 7. Thus, directions were issued to the petitioner to file documents before this Court to show any active listing of the product under the mark ‘EVERSHINE’, by the respondent. 8. However, despite opportunities by this Court, no such documents have been filed by the petitioner. This is a digitally signed order. 9. Accordingly, considering the Compliance Affidavits, this Court is of the view that the orders dated 22nd November, 2022 and 03rd March, 2023 as aforesaid, stand complied with. 10. Accordingly, no further orders are required to be passed in the present petition. 11. The present petition is accordingly disposed of.
