1. The present petition seeks cancellation of bail which had been granted to the concerned accused i.e. respondent herein on 22.11.2023.
2. Learned APP for State submits that the quantity of contraband in question is commercial in nature and the learned Trial Court has granted bail to the respondent while observing that there was infraction of Section 52(A) of Narcotic Drugs and Psychotropic Substances Act, 1985.
3. When asked, learned APP for State submitted that 15 out of 24 cited witnesses have already been examined and as per instructions, which she has received from the I.O., trial is progressing on day-to-day basis.
4. In view of the above and keeping in mind the fact that bail was granted on 22.11.2023, this Court does not find any compelling reason to interfere with the abovesaid order. It is, however, clarified that the observations made in the abovesaid order would be taken as tentative in nature and would not prejudice the mind of the learned Trial Court at the final stage of the case.
5. The petition is, hereby, dismissed.
