National Lok Adalat 593 FAO-1882-2024(O&M) NOOR MOHAMMAD AND ANOTHER V/S AKHTAR AND OTHERS Present: Mr. Ashish Gutpa, Advocate, for the appellants. Ms. Babita Rawat, Deputy Manager, for the respondent-Insurance Company. CM-7204-CII-2024 This is an application under Section 5 of the Limitation Act, seeking condonation of delay of 40 days in filing the accompanying appeal. For the reasons mentioned in the application, the same is allowed and the delay of 40 days in filing the present appeal is condoned. FAO-1882-2023 The statements of learned counsel for the appellants and the representative of the respondent – Insurance Company have been recorded separately. As agreed, a sum of Rs.8,90,000/- over and above the amount awarded by the Tribunal is acceptable to both parties. Thus, the said enhanced amount is allowed to the appellants as full and final settlement of their claim, over and above the amount already awarded in the main appeal, in proportion as determined by the Tribunal. As per the statement made by learned counsel for the appellants, the enhanced amount be paid to appellant No.1-Noor Mohammad. Accordingly, the matter is disposed of with a direction to the Insurance Company to deposit a crossed-cheque for Rs.8,90,000/- in the name of appellant No.1 with the office of the Lok Adalat of the High Court on or before 15.10.2026, failing which, interest @ 9% per annum shall follow on this amount till payment from the date of this order. The concerned Officer of the Lok Adalat Branch/Office shall issue proper receipt after receiving the cheque to learned counsel/representative of the respondent–Insurance Company. The appellant’s counsel/appellant(s) may collect the cheque from the office of the Lok Adalat. Copy of the order be supplied/sent to the counsel/parties and file be returned to the Hon'ble High Court.
