1. The present petition alleges disobedience of the order dated 26th April, 2023, which reads as follows:
“Issue notice. Mr. Subhash Tanwar, learned counsel accepts notice on behalf of Respondent Nos. 1 and 3. Mr. Uttam Dutt, learned counsel accepts notice on behalf of Respondent No.2. Counter affidavits be filed within a period of four weeks from today. Rejoinder, if any, be filed within two weeks thereafter.
Learned counsel for the Petitioner, at the outset, also submits that some legal objection has been raised by the Petitioner in the inquiry proceedings against which the recourse will be taken by the Petitioner before the Disciplinary Authority. Since the challenge is laid to the issuance of the charge memorandum, it is directed that the Inquiry Authority will not render the final report till the next date of hearing and is permitted to go on with the inquiry proceedings. List the writ petition for final hearing on 21.07.2023.” This is a digitally signed order. 2. The aforesaid order directed that the Inquiry Authority shall not render its final report till the next date of hearing, while permitting the inquiry proceedings to continue. 3. Mr. Ankur Chhibber, Senior Counsel appearing for the Petitioner, submits that despite the specific directions of this Court, the Inquiry Authority, on 30th April, 2024, submitted the inquiry report to the Disciplinary Authority and also forwarded a copy thereof to the Petitioner calling upon him to submit his representation/reply. According to Mr. Chhibber, this amounts to rendering the “final report”, contrary to the directions contained in the order dated 26th April, 2023. 4. In response, counsel for the Respondents initially sought to explain that their understanding was that the order dated 26th April, 2023 had been vacated. However, he did not press the said contention and instead invited the Court’s attention to the affidavit filed by Mr. Soumendra Das, Company Secretary of Respondent No. 2, M/s SJVN Ltd., wherein an unconditional apology has been tendered for the disobedience of the order. It is further submitted that there was no intention on the part of Respondent No. 2 to disobey the order of this Court and, in any event, no final order has been passed by the Disciplinary Authority. 5. The Court has considered the aforesaid submissions. Since the Disciplinary Authority has not passed any final order and Respondent No. 2 has tendered an unconditional apology, no further orders are called for in the present contempt proceedings. The present petition is accordingly disposed of with a caution to Respondent No. 2 to scrupulously adhere to the directions passed by this Court.

appropriate clarification from the Court rather than proceed on the assumption that the order stands vacated. The Court also considers it appropriate to impose costs of INR 5,000/- upon Respondent No. 2, to be deposited with the Delhi High Court Legal Services Authority. 6.
