Vide order dated 28th March, 2026, this Court directed as under: “4. Accordingly, Ms. Urvi Mohan, Id. Counsel appearing for the Government of National Capital Territory of Delhi (hereinafter, ‘GNCTD’) is requested to accept notice for the PWD and it is directed that the MCD and the PWD shall together carry out the desilting of the entire Malviya Nagar area including of the main drain so that in the forthcoming rains there is no waterlogging in the said area. It is directed that mechanised desilting shall be carried out in the Malviya Nagar area by the concerned agencies on a regular basis. xxxx 6. Insofar as parking of vehicles is concerned, the expansion of the drain cannot be stopped on the ground of parking of vehicles. Accordingly, a meeting shall be held with the President and the Secretary of the RWA, This is a digitally signed order. Let the MCD and thePWD file a joint status report by the next date of hearing regarding the following aspects: • Desilting work undertaken; • The decision taken in the meeting with the RWA; and • Status of the expansion of the drain, if any.” 3. The meeting, as directed in the order dated 28th March, 2026, is also stated to have been held on 16th April, 2026 between the various authorities including the Resident Welfare Association, Councillor of the MCD, Public Works Department (hereinafter, ‘PWD’), etc. 4. The status report of the Municipal Corporation of Delhi (hereinafter, ‘MCD’) has been perused. As per the same, the desilting of the drain of Khirki Road and APJ School Road was done and very little waterlogging happened during the present monsoon. 5. Ld. Counsel for the MCD and PWD have confirmed that there were no major complaints during this period. 6. Considering the above, it is directed that the desilting work shall be carried out on a regular basis, at least once in three months and whenever waterlogging is reported by the residents, prompt action shall be taken by the concerned authorities. 7. In addition, the Councillor of the MCD and the office bearers of the Resident Welfare Association shall co-ordinate with any one official from the PWD as also the MCD on a regular basis to ensure that the drain is fully This is a digitally signed order. Counsel appearing for Mr. Suri, President of the Residents Welfare Association also submits that the desilting work was done, however there is a nearby jhuggi jhopdi cluster from where the sewage is flowing into the storm water drain. In this regard, the Resident Welfare Association may approach the MCD or the PWD for initiating appropriate action in accordance with law. 10. Petition is disposed of in these terms.
