1. This application is filed jointly on behalf of the Plaintiffs and Defendant under Order XXIII Rule 3 read with Section 151 CPC for recording of settlement between the parties. This suit was instituted on behalf of the Plaintiffs inter alia seeking a decree of permanent injunction restraining infringement of Indian Patent No. IN 228720, which has expired on 12.03.2024 in India. Defendant had filed a revocation petition being C.O. (COMM. IPD-PAT) 01/2024 and vide order dated 22.01.2025, petition was dismissed as not pressed. Thereafter, second party filed I.A. 10183/2025 for revival of the petition after recalling order dated 22.01.2025, which is pending. Parties have amicably settled their disputes and the terms of settlement are incorporated in a Settlement Agreement dated 14.04.2026, which is confidential in nature and has come into effect from 14.04.2026.

application and finds the same to be lawful. It is inter alia agreed between the parties that the Settlement Agreement constitutes full and final settlement of the disputes in the present suit and that they shall have no further claims or demands of any nature whatsoever against each other.
3. Accordingly, this application is allowed and disposed of, recording the settlement between the parties.

4. Suit is decreed in terms of the settlement and needless to state, the Settlement Agreement dated 14.04.2026 shall form a part of the decree and bind the parties thereto.
5. Registry is directed to draw up the decree sheet.
6. Plaintiffs are held entitled to refund of entire Court fees in accordance with the Court Fees Act, 1870.
7. In light of the settlement between the parties, Defendant is absolved of its liability to earmark 20% of the net value of the sales generated from the impugned product in a No Lien account and not use the same, as earlier
directed by this Court on 25.09.2024. IDBI Bank is directed to change the status of bank account No. 0019102000026248 and remove the ‘No Lien’. Consequently, Defendant shall be permitted to operate the bank account without any restrictions.
8. Suit stands disposed of along with pending applications.
9. Date of 14.09.2026 stands cancelled.
