A status report has been filed on behalf of respondent no.1/MCD on 21st September, 2024, wherein it is stated that the property in question, i.e., House No. 1340, Gali No. 43, Jafrabad, Delhi- 110053 (‘subject property’), was inspected on 17th September, 2024 and it was found that a Madarsa in the name and style of ‘Baitul Uloom’ was found running at the subject property and the same has been in existence prior to 2003. Hence, the said property is entitled to protection under the Delhi Laws (Special Provisions) This is a digitally signed order. In respect of the second property bearing no.1114, Gali no. 45, Jafrabad, Delhi, the same was inspected on 17th September, 2024 and unauthorized construction in the shape of 4th floor with projection over municipal land was found, which was booked on 17th September, 2024 and a show cause notice was issued. 3. After filing of the said status report, a demolition order was passed by respondent no.1/MCD on 13th December, 2024, directing the owner/occupier of the said property to demolish the unauthorised 4th floor. 4. Counsel appearing on behalf of private respondent no.5 submits that the unauthorized construction has been removed by the said respondent itself. 5. None appears on behalf of the petitioner. 6. On the last date of hearing also, an adjournment was sought on behalf of the petitioner. 7. Taking note of the aforesaid, the present petition stands disposed of.
