It is noticed that there is no appearance from the side of respondent No.2 despite the fact that respondent No.2 is duly served. 3. In view of the abovesaid peculiar situation, Mr. Jain, learned counsel for petitioner, without prejudice to his rights and contentions, seeks to withdraw the present petition with liberty to file appropriate petition seeking quashing of the FIR on merits of the case. 4.
