Afzal for R2, R4 No appearance - R3 O R D E R This Writ Petition has been filed to direct the respondents 2 to 4 to return the document of title with respect to dwelling house property of the petitioner situated at Old Door No.51, New No.212, Kancheepuram Street, Pothaturpet, Pallipet Taluk, Thiruvallur District and the connected documents. 2. According to the petitioner, he obtained three term loans and one capital loan from the respondents 2 to 4 and the petitioner had deposited the title deed of his house property bearing Old No.51, New No.212, Kancheepuram Street, Pothaturpet, Pallipet Taluk, Thiruvallur District, as collateral security for the grant of loan by the 3rd respondent. Though the petitioner settled a sum of Rs.4,13,418/- as against the total loan amount of Rs.11,10,31,243.80/- within 30 days under the Special One Time Settlement Scheme, as per letter of the 3rd respondent dated 30.08.2022, the respondents did not return the original title deeds. When the petitioner approached the 3rd https://www.mhc.tn.gov.in/judis WP No. 7035 of 2024 __________ Page3 of 6 respondent, by way of letter dated 28.08.2023, the 3rd respondent informed that the office of the 3rd respondent is merged with the office of the 4th respondent and when the petitioner approached the 4th respondent, the said authority is also making evasive replies, hence the petitioner has come up with the present petition. 3. The learned counsel appearing for the petitioner would submit that the petitioner had met with an accident and sustained spinal cord injury and he is bedridden. Moreover, the petitioner had contacted the 3rd respondent over phone and there is no response and the 3rd respondent by way of a letter dated 28.08.2023 informed that the office of the 3rd respondent is merged with the office of the 4th respondent and in turn, there is no response from the 4th respondent, thereby submits that a direction may be issued to the 4th respondent to return the original documents. 4. Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the 1st respondent and the learned counsel appearing for the respondents 2 and 4. As on date, the petitioner has not taken notice to the 3rd respondent, since no adverse order has been passed as against the 3rd respondent, notice to the 3rd respondent is dispensed with. https://www.mhc.tn.gov.in/judis WP No. 7035 of 2024 __________ Page4 of 6 5. On a careful perusal of the documents placed on record it is seen that the petitioner borrowed loan from the respondents 2 to 4 and claim he paid the entire amount by way of one time settlement and even thereafter, the original document has not been returned to the petitioner. 6. Considering the facts and circumstances of the case and taking note of the fact that the petitioner paid the entire loan amount by way of one time settlement or by any other mode, upon satisfaction, the 4th respondent is directed to return the original documents within a period of six weeks from the date of receipt of copy of this order. In the result, the Writ Petition is disposed of.
