The said submission raised by the petitioners seems to be correct as the petitioners were not heard. The amount from the petitioners’ account was directed to be transferred to the complainant’s account. This order could not have been passed without affording opportunity of hearing to the petitioners. 2. In view of the aforesaid, the matters are remitted back to the concerned Magistrate who shall hear the petitioners and to pass fresh orders. The petitioners, thereafter, if have any grievance shall be at liberty to take appropriate remedy. 3.
