1. The instant application has been filed under Section 439 of the Code of Criminal Procedure, 1973 (Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023) of the by the application seeking grant of regular bail in relation to FIR No.111/2023 dated 23.04.2023, registered at P.S Special Cell, under Sections 18/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act), pursuant to which a case bearing SC No.384/2023 is pending before the Court of Special Judge, NDPS Court, Patiala House Court, New Delhi. 2. The FIR would show that on 23.04.2023, the applicant was found in possession of 5.310 kg of opium (in his bag), whereas 96.310 kg was recovered from the truck which was driven by him. The applicant was arrested on 23.04.2023 itself. After investigation, the charge sheet has been filed, however, the charges have not yet been framed. The applicant submits that he has been falsely implicated in the instant case on the basis of mere This is a digitally signed order. suspicion having no concern with the alleged offence. No independent witnesses are available. It is submitted that it was impossible for the truck to be at the spot at the alleged time, as the entry of commercial vehicles in Delhi is prohibited till 7:00 A.M to 11:00 P.M. The violation of Sections 50 and 52A of the NDPS Act has been alleged. Additionally, it is contended that another accused namely, Dalu @ Dalchand has already been enlarged on regular bail by the co-ordinate Bench of this Court in Bail Appl. No.3280/2025 vide order dated 02.04.2026. 3. The aforesaid submissions are strongly opposed by the learned APP for the State. It is contented that bearing in mind the material which has come on record, the applicant is not entitled for regular bail. 4.
The Court, however, finds that applicant is under incarceration since 23.04.2023; a period of more than 3 years have elapsed; the charges have not yet been framed; there are multiple witnesses and the completion of trial will take sufficient time. 5. A perusal of the material available on record would indicate that the role assigned to the present applicant and another accused namely, Dalu @ Dalchand is almost similar. Rather, it is at the instance of said Dalu @ Dalchand, the applicant was carrying the alleged contraband. 6. Bearing in mind the overall facts and circumstances of the case, the Court finds that the present applicant is entitled to be enlarged on regular bail on the ground of parity. The Court, thus, directs the release of the present applicant subject to the conditions to be imposed by the Trial Court. 7. With the aforesaid, the instant application stands disposed of.
