ORDER This Writ Petition is filed for a direction to the second respondent to consider the representation of the petitioner, dated 19.12.2023 in accordance with law within the stipulated time as fixed by this Court.
2. It is the contention of the petitioner that he owns an agricultural land in Kondappa Nayakkanpalayam in S.F.Nos.8/1, 8/28 and 9/1 to an extent of 8.05 acres. For irrigation of the said land, the petitioner and the private respondents made an application before the Revenue Department to draw water in the open well situated in S.F.No.83/3A3A. Accordingly, they obtained the permission to draw the water. However, subsequently, the private respondents dig a well 200 meters away from the open well in S.F.No.83/3A3A and shifted the motor pumpset to the new well to draw the water. Objecting the same, the petitioner made a representation, dated 19.12.2023 for removal of illegal electricity motor pumpset erected in the new well. However, no orders were passed so far. 3. Learned Counsel for the petitioner submits that this Court may direct the second respondent to consider and pass orders on the petitioner’s representation within the stipulated time as fixed by this Court.
4. Learned Additional Government Pleader for the respondent Nos.1 and 2 submits that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.
5. Heard the learned Counsel on either side and perused the materials available on record.
6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this Court directs the second respondent to consider and pass orders on the petitioner's representation, dated 19.12.2023 within a period of twelve weeks from the date of receipt of a copy of this order after providing an opportunity to the above said persons and aggrieved persons, if any. 3/5 https://www.mhc.tn.gov.in/judis
