For Petitioner(s): Mr.S.Ramajayam For Respondent(s): Mr.P.Harish Government Advocate ORDER This Writ Petition has been filed seeking issuance of writ of mandamus, directing the first and second Respondents to consider the representation dated 16.09.2024 and further directing the respondents 1 and 2 refuse to register the documents under Registration Act if the respondents 3 to 10 present the documents for registration based on the title traverse from forged unregistered wills dated 12.12.2001 and 02.01.2002 in S. No 394/ 2 and 410 of Thottipalayam Village, Tirupur Taluk and District. 2. The learned counsel appearing for the petitioner would submit that though the petitioner obtained a decree from a suit in her favour, the respondents 3 to 10 intend to execute the document in respect of the subject survey number i.e., S.No.394/2 and 410 therefore, she made a representation dated 16.09.2024, not to register the documents in respect of the subject survey https://www.mhc.tn.gov.in/judis WP No. 38154 of 2024 __________ Page3 of 4 number, if any presented for registration. Since the same has not been considered, the petitioner is before this Court. 3. The learned Government Advocate appearing for the respondents 1 & 2 would submit that the representation has to be filed in a proper format along with fee, which has not been done by the petitioner. 4. Heard the learned counsel appearing for the petitioner as well as the respondents and perused the material available on record. 5. In view of the submissions made, the petitioner is directed to file a fresh representation in a proper format along with required fee. If any such representation or any document is presented by the respondents 3 to 10, the official respondents are directed to consider and pass orders on the same, after issuing notice and affording an opportunity of hearing / filing objections to the petitioner as well as the necessary parties. 6. This Writ Petition is disposed of with the above terms.
