(Oral) CM-11741-CII-2026 This is an application under Section 151 CPC for fixing an actual date of hearing/early hearing of the main revision petition. Ms. Kiran Bala Jain, Advocate, puts in appearance on behalf of the non-applicant/petitioner and submits that she has no objection, if the prayer made in the application is allowed. Accordingly, in view of the above and for the reasons set out in the application, supported by affidavit, the same is allowed; and with the consent of learned counsel for the parties, the main case is taken on board for hearing today itself. CM stands disposed of. CR-4634-2024 1. This is a petition under Article 227 of the Constitution of India, HARISH KUMAR 2026.07.29 18:20 I attest to the accuracy and authenticity of this order/judgment CR-4634-2024 (O&M) (2) for setting aside order dated 20.10.2023 (Annexure P-1), whereby the defence of the petitioner was closed by order of the Court, as well as order dated 22.07.2024 (Annexure P-2), whereby the application for recalling order dated 20.10.2023 was dismissed. 2. At the outset, learned counsel for the plaintiff-respondent submits that she has no objection if the impugned order dated 20.10.2023 is set aside and petitioner is granted one opportunity to file its written statement and is further directed to compensate the respondent for the delay, by imposition of costs. 3. Learned counsel for the petitioner submits that the written statement is ready and in case one opportunity is granted, the same will be filed on the date already fixed before the trial Court, i.e. 31.07.2026. 4. In view of the consensus arrived at between the parties, the present petition is allowed. The impugned order dated 20.10.2023 (Annexure P-1) is set aside, subject to payment of Rs.20,000/- as costs, to be paid to the plaintiff-respondent; and one opportunity is granted to the defendant-petitioner to file its written statement as well as reply to the injunction application on the date fixed before the learned trial Court. It is made clear that failing to file the written statement or to pay costs in terms of this order, the defendant-petitioner would not be entitled to any further opportunity for the said purpose and the trial Court would proceed with the matter without this order having any bearing on the trial. 5.
