HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU
Arb P No. 41/2024
M/S Zapp Hotels & Resorts Pvt. Ltd. …..Petitioner(s)
Through: None.
Vs
M/S Devi Ashirwad Resorts Pvt. Ltd. .….Respondent(s) Through: Mr. Aditya Gupta, Advocate.
CORAM: HON’BLE MR. JUSTICE SANJAY DHAR, JUDGE
ORDER (10.03.2026)
01.
Learned counsel for the respondent has submitted that the petition is pre-mature inasmuch as the petitioner has never invoked the arbitration clause. When this objection was raised by the learned counsel for the respondent on 20.02.2026, learned counsel for the petitioner sought time and the matter was adjourned to 23.02.2026. On the said date, no one appeared on behalf of the petitioner and the matter was adjourned for today.
02. None has appeared on behalf of the petitioner today also. It seems that the petitioner has lost interest in prosecuting the present petition. Accordingly, the same is dismissed for non- prosecution along with connected application(s), if any.
03. Interim direction, if any, shall stand vacated.
