Sumathy Standing Counsel For R2 & R4 ORDER This writ petition has been filed seeking to direct the respondents to provide service road in the development of Satellite Town Ring road as assured https://www.mhc.tn.gov.in/judis WP No. 29917 of 2024 by the 1st respondent during the public hearing held on 31.05. 2019 at 10.30 AM in the District Forest Officer Complex, Mathigiri, Hosur. 2.Learned counsel for the petitioners would submit that the National Highways Authorities have acquired the petitioner’s land under the provisions of National Highways Act, 1956 for the project of Satellite Town Ring Road and the compensation was also paid. Further, the 1st respondent has promised the petitioners and other farmers that the service road will be provided to access the agricultural lands struck in between the national highways road. However, the respondents have failed to provide the said service road. Hence, the present writ petition has been filed. 3.Learned Additional Government Pleader appearing for the respondents 1 and 3 and the learned Standing Counsel appearing for the respondents 2 and 4 by referring paragraph No.23 of their counter affidavit would submit that the competent Authority of NHAI, New Delhi has accorded approval to take up the construction of service road for the entire length of 35.76 kms and hence, the request of the petitioner to lay the service road has been considered and hence the prayer sought for in this writ petition has become infructuous. 4.Heard the learned counsel for the petitioners; learned Additional Government Pleader appearing for the respondents 1 and 3 and the learned https://www.mhc.tn.gov.in/judis WP No. 29917 of 2024 Standing counsel appearing for the respondents 2 and 4. 5.Considering the submissions made by either parties, it is evident that according to the petitioners the respondents has failed to form a service road as promised by them during the acquisition of their lands for the project of Satellite Town Ring Road. However, the respondents would submit that they are under the process of laying the service road as requested by the petitioners and other public and the approval has also been obtained from the competent Authority. 6.At this juncture, it would be apposite to extract paragraph No.23 of the counter filed by the respondents 2 and 4, which reads as follows:- “23 Regarding the averments made from para 11 to 14 of the affidavit, I submit that the Competent Authority of NHAI HQ has already approved for construction of service road for a distance of about 10.82 Km. and Vehicular Overpass (VOP) at an estimated cost of Rs.55.20 Cr. It is further submitted that considering the persistent demand of the public in the project area for construction of service road for entire length of 35.76 Km. in Krishnagiri District, Tamil Nadu, the issue was taken up with the NHAI HQ and the Competent Authority of NHAI, New Delhi has accorded approval to take up the construction of service for the remaining project length in Tamil Nadu through a separate tender process. Hence, the prayer of the Writ Petitioners has already been complied with and it has become infructuous.” 7.A reading of the above would show that as per the assurance given by the 1st respondent, the approval has been obtained from the competent Authority of NHAI, New Delhi for the construction of service road for entire length of 35.76 Km in connection with the Satellite Ring Road project in Krishnagiri District, Tamil Nadu. Therefore, they are under the process of laying the service road. Hence, the prayer sought for in this writ petition has been achieved. Thus, no further order is required in the present case. 8.Accordingly, this writ petition is disposed of recording the submissions of the respondents.
