Vide the application at hands, the applicant/ petitioner seeks transfer of petition filed under Section 482 Cr.P.C. being CRM(M) No. 220/2022 (Shabir Ahmed Khan vs. Union Territory of J&K & ors.), pending before the Srinagar Wing of this Court, to Jammu Wing. 02. Learned counsel for the applicant/petitioner submits that the FIR in question was registered in the year 2014. And, the charges thereafter were framed in April 2015 and thus, nearly 11 years have gone by. Accordingly, it is urged that the circumstances/reasons/ground on which the transfer of Criminal Miscellaneous Application, CRM(M) No. 220/2022, was, perhaps, sought, no longer exist.
