Learned counsel submits that the appeal filed by the petitioner against his conviction is pending, however, as per instructions dated 31.05.2013, Annexure P-1, the benefit of leave encashment cannot be withheld and this aspect has not been considered in the impugned order dated 02.01.2024, Annexure P-4. Hence, he restricts his claim at this stage to the extent of directing the respondents to decide the said aspect in a time bound manner. 2. In view of the above and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondent No.5 to look into the abovesaid aspect expeditiously in accordance with law and decide the same within a period of 03 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to him and if found entitled, grant the benefit forthwith.
