3.
Learned counsel for respondent Nos.2 and 5-NHAI pointed out that process of acquisition of land and to provide passage and under-bridge is in progress.
4.
A period of 2½ years expired but respondents did nothing. Passage and under-bridge was not constructed. Thus, this Court granted one week’s time to respondents to do the needful.
5.
Learned counsel for respondent Nos. 2 and 5-NHAI pointing out affidavit dated 18.05.2026 of the General Manager (Tech.)-cum-Project Director, Project Implementation Unit, Ludhiana, submits that on account of multiple issues Highway is yet to be constructed. It is delayed for the reasons beyond control of authorities. Passage and under-bridge would be constructed the moment National Highway is constructed. The respondent-NHAI is not deflecting from its responsibility, however, it is not viable to construct the under-bridge till road is constructed.
6.
The petitioner who is present in person submits that his land has already been acquired, however, under-bridge is not constructed. He does not dispute that he has already received compensation. However, he needs passage to utilize his remaining land. His remaining land is locked unless and until passage is provided.
7.
Learned counsel for NHAI submits that till the road is constructed, ground level position is same and petitioner can utilize passage as was utilizing earlier.
8.
In the wake of statement of learned counsel for respondent-NHAI that under-bridge would be constructed the moment road is constructed, no further order at this stage is warranted. The petitioner would be at liberty to avail remedies as permissible by law, if under-bridge is not constructed in due course.
