OD 7 CC/85/2024 IN THE HIGH COURT AT CALCUTTA SPECIAL JURISDICTION (CONTEMPT) ORIGINAL SIDE SRI BISWAJIT SANTRA VS SMITA PANDEY AND ORS. BEFORE: The Hon'ble JUSTICE RAI CHATTOPADHYAY Date: 16th September, 2026. Appearance: Mr. Shubradip Roy, Adv. Ms. Sananda Ganguli, Adv. . . .for the petitioner. Mr. Jishnujit Roy, Adv. Mr. Deveshi Bose, Adv. . . .for the alleged contemnors. The Court: Parties are represented. Compliance report is submitted by the alleged contemnor indicating therein that order of this Court dated 27th February, 2024 in writ petition No.WPO 165 of 2018 has been duly complied with by the alleged contemnors by dismantling the fittings in the park area as well as plackets and handing over vacant and free possession of the piece of land to the petitioner. The report is taken on record. 2 Mr. Shubradip Roy learned advocate for the petitioner has submitted that still the flooring and pavement remains over there which has not been demolished by the alleged contemnor in the process of handing over possession of the premises to the petitioner. Having considered the respective submissions of the learned advocates as well as the compliance report filed, it appears that the order of this Court as above has been duly and substantially complied with by the alleged contemnor by removing the plackets and fixtures over the land and handing over free possession thereof to the petitioner. In such view of the fact, the Court does not find any reason to keep this contempt application pending any further. Hence, the same is disposed of. It is directed further that any flooring, if still remains, be removed at the instance of the petitioner himself. Any step, if contemplated to be taken by the BL and LRO in connection with the instant contempt matter should be unnecessary and infructuous, in view of the current development, as stated above. The parties may inform the BL and LRO accordingly. Contempt application, being CC/85/2024 is disposed of. (RAI CHATTOPADHYAY, J.) sp/
