… for the State. 1. Affidavit-of-service, filed by the petitioner in Court today, is taken on record. 2. The petitioner filed an application under Section 6 of the Right to Information Act, 2005 seeking, inter alia, the following information:
“a) How much land has been acquired from the plot No-474, 491, 492, 493, 495, 499, 500 & 501 of Mouza – Puapat J.L. No-133 P.S. Debra Dist- Paschim Medinapore in LA Case No-131/69-70? b) How much land has been handed over to the P.W.D. Road Authority from the Plot No-474 & 492?”

The District Magistrate, Paschim Medinipur, by a Memo No.151/RTI dated 26th April, 2024, transferred the said application to the Special Land Acquisition Officer, Paschim Medinipur, with a direction to send a reply to the petitioner within the stipulated time in terms of the Right to Information Act, 2005. 4. Subsequently, the SPIO & Special Land Acquisition Officer, Paschim Medinipur, by a Memo No.731/LA dated 23rd July, 2024 informed the petitioner that the information sought for by the petitioner is in
2 connection with an LA Case, bearing No.131/1969- 70, which is more than 50 (fifty) years old and the records thereof are not readily available. The petitioner was further informed that the information would be furnished as soon as the records are made available. 5. Since nothing fruitful had happened, the petitioner moved this writ petition challenging the inaction on the part of the respondents in not providing the information under the Right to Information Act, 2005. 6. Learned counsel for the State respondents sought for two weeks’ time to take instructions in this matter. 7. It appears that no useful purpose will be served in keeping this matter pending. 8. Under such circumstances, I direct the respondent no. 4 to furnish the information as sought for by the petitioner in the application dated 18th April, 2024 within a period of four weeks from the date of communication of this order. 9. The instant writ petition, being WPA No. 27947 of 2024 stands disposed of. 10. No order as to costs. 11. Urgent certified photostat copy of this order, if applied for, be given to the parties on compliance of requisite formalities.
