The Court:- This is an application for grant of Letters of Administration of the estate left behind by the deceased with the Will annexed. The petitioner contends that the testatrix has no known legal heir. A ‘No Caveat Certificate’ has been issued by the department which indicates that despite issuance of general citation and publication thereof in newspapers, no caveat has been entered against the grant. The Will has been proved in common form by one of the attesting witnesses. Having regard to the above and since the file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the department, therefore, considering the view of the department, this application for grant of Letters of Administration is allowed subject to the petitioner furnishing a personal bond for a sum of Rs. 5,00,000/- (Rupees Five Lakh only) with two sureties. There will thus be an order in terms of prayer (c) of the petition. Accordingly, PLA/241/2024 stands disposed of. (OM NARAYAN RAI, J.) spal
