No Caveat Certificate issued by the department indicates that general citation had been published in the Sunday edition of The Telegraph as well as Anandabazar Patrika. However, despite issuance of general citation and publication thereof, no caveat has been entered against the grant of probate. The Will has been proved in common form by one of the attesting witnesses. 2 Having regard to the above and since this file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the department, therefore, considering the view of the department, application for grant of probate is allowed, by passing orders in terms of prayer (c) of the application.
