The Court :-This is an application for grant of probate of the last Will and Testament dated September 17, 2022 left behind by the deceased above named. The husband of the deceased predeceased her. The testatrix died issueless. The application states that the petitioner has no knowledge about any heir or near relative of the deceased, who could have inherited the estate of the deceased in case of intestacy. The department has issued a “no caveat” certificate indicating that despite issuance and publication of citation, no caveat has been entered against the grant of probate. The Will has been proved in common form by one of the attesting witnesses. 2 In view of the aforesaid and since this file has been placed before this Court by the learned Registrar (Insolvency) upon complete scrutiny by the department for grant, therefore, considering the view of the department the application for grant of probate is allowed by passing order in terms of prayer (d) of the petition.
