The Court:- This is an application for grant of probate of the last Will and Testament dated September 24, 2003 and the Codicil dated February 8, 2008 left behind by the above-named deceased. The petitioner has stated that the petitioner is unaware of the whereabouts of any surviving legal heirs of the testatrix. Accordingly, citations were issued and published. A ‘No Caveat Certificate’ has been issued by the department stating that no caveat has been entered against the grant of probate despite issuance of citation. The Will was registered in the Office of the Additional Registrar of Assurances- III, Calcutta on September 24, 2003. The Codicil was registered in the Office of the Registrar of Assurances-III, Calcutta on February 8, 2008. Both the Will as well as the Codicil have been proved by one of the attesting witnesses. 2 Having regard to the above and since the file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the department, therefore, considering the view of the department, this application for grant of probate is allowed by passing orders in terms of prayer (c) of the petition.
