OD-20 IN THE HIGH COURT AT CALCUTTA (Testamentary and Intestate Jurisdiction) ORIGINAL SIDE PLA/264/2024 IN THE GOODS OF: SM GOURI BHOWMICK (DECEASED) BEFORE: The Hon'ble JUSTICE OM NARAYAN RAI Date : 17th August, 2026 Appearance: Mr. S. Khan, Adv. …for the petitioner The Court:- This is an application for grant of probate of the last Will and Testament dated March 7, 2018 left behind by the abovenamed deceased. The testatrix is survived by four legal heirs who have been described in paragraph 5 of the application. The husband of the testatrix pre-deceased her as indicated in paragraph 5 of the application as well as in the Will. Out of four legal heirs described in paragraph 5, one has consented to the grant by filing affidavit of consent. Insofar as the other three are concerned while there is no affidavit of consent filed by them, at the same time, the Department has issued “No Caveat Certificate” stating that no caveat has been entered against the grant of probate of the last Will and testament dated March 7, 2018 despite issuance of citation. The Will has been proved in common form by one of the attesting witnesses. 2 Having regard to the above and since the file has been placed before this Court by the Registrar Insolvency for grant upon complete scrutiny by the Department, therefore, considering the view of the Department, this application for grant of probate is allowed by passing orders in terms of prayer (c) of the application. PLA/264/2024 stands disposed of. (OM NARAYAN RAI, J.) S.Bag
