The Court:- This is an application for grant of probate of the last Will and Testament dated September 13, 2013 left behind by the above-named deceased. The Will is registered in the office of the Additional District Sub-Registrar, Bidhannagar, Salt Lake City. The Will indicates that the testator died issueless and that the wife of the testator predeceased him. The Will further clarifies that the testator has no heir within the First Schedule (i.e. no Class I heir). The persons who would have otherwise inherited the estate of the deceased if the deceased had died intestate have been described in paragraph 10 of the application. Since none had consented to the grant, citations both special and general had been issued. The special citation was also published in the Times of India as well as Anandabazar Patrika. The Department has issued a No Caveat Certificate indicating that despite issuance of citation and publication thereof in the Sunday editions of the Times of India and Anandabazar Patrika, no caveat has been entered against the grant of probate of the said Will and Testament. 2 The Will has been proved in common form by one of the attesting witnesses. Having regard to the above and since the file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the department, therefore, considering the view of the department, this application for grant of probate is allowed by passing orders in terms of prayer (a) of the petition.
