The Court:- This is an application for grant of Probate of the last Will and testament dated November 21, 2022 left behind by the above named deceased. The husband of the testatrix predeceased her and the testatrix has died issueless. The Will indicates that she has only one nephew as her successor. The application for grant of probate indicates that the executor is unaware of any legal heir that may be surviving who could be entitled to the estate of the deceased in case the testatrix had died intestate. Accordingly, citations had been issued and the gist of the general citation had also been published in two newspapers. The department has issued a no caveat certificate indicating that despite issuance of citation and publication thereof in ‘The Telegraph’ in English and ‘Bartaman’ in Bengali on November 9, 2025, no caveat has been entered against the grant of Probate. The will has been proved in common form by one of the attesting witnesses. Having regard to the above and since the file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the department, therefore, considering the view of the department, the application 2 for grant of probate is allowed by passing orders in terms of prayer (d) of the application.
