The Court :-This is an application for grant of probate of the last Will and Testament dated October 20, 1995 left behind by the deceased above named. The husband of the deceased has predeceased her. The testatrix is survived by four legal heirs. One of them has consented to the grant while the other three have not. The other three have also not come forward to oppose the grant. A “No caveat certificate” has been issued by the department stating that no caveat has been entered against the grant of probate despite issuance of citation. The “No caveat certificate” indicates that special citation had also been published in the newspapers. The Will has been proved in common form by one of the attesting witnesses. 2 In view of the aforesaid and since this file has been placed before this Court by the learned Registrar (Insolvency) upon complete scrutiny by the department for grant of probate, therefore, considering the view of the department, the application for grant of probate is allowed by passing order in terms of prayer (c) of the petition.
