The Will has been registered in the office of the Additional District Sub-Registrar, Alipore on February 21, 2019. The legal heirs of the deceased have been described in paragraph 4 of the application. One of the legal heirs is the executor. The other three have consented to the grant by filing their respective affidavits of consent. The Will has been proved in common form by one of the attesting witnesses. In such view of the matter, since the file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the Department, therefore, having regard to the above and considering the view of 2 the Department, this application for grant of probate is allowed by passing orders in terms of prayer (a) of the application. PLA/300/2024 stands disposed of. GA/2/2025 has been filed for bringing on record the present position in law upon the Hon’ble Division Bench of this Court delivering judgment in APOT/139/2025 on September 22, 2025. In view of the application for grant of probate having been allowed as aforesaid, GA/2/2025 stands disposed of.
